Terms of Service
1. Introduction
These Terms of Service (the "Terms") govern your use of the services provided Den of Imagination spolka cywilna Dariusz Piotrowski, Michal Ruminski Tax ID - PL8792676874 ul. Wielki Row 40b, 87-100 Torun, Poland painting studio (the "Studio"). By using the Studio's services, you agree to be bound by these Terms.
2. Services
The Studio provides a variety of services related to wargaming and collecting miniatures, including:
Painting and assembling miniatures to your specifications
Basing miniatures
Repairing damaged miniatures
Providing advice and guidance on miniature painting
Converting and sculpting models
3D sculpting and 3D printing of created miniatures
3. Placing an order
We do not have a standard sales module on our website. To place an order, please contact the Studio via email [email protected] or the contact form on the website.
After discussing the details, the Studio will provide an individual quote.
Once the quote is accepted, payment details will be sent. If you wish to pay by card through the external payment system Imoje, payment links will be generated.
Acceptance of the quote means acceptance of the terms of service.
4. Fees
The Studio's fees for its services can be found in the "Services" tab.
Prices shown in the price list are indicative and may vary depending on the painting level, scheme, and other factors affecting the painters' working time.

5. Payments
Payment for the Studio's services requires a 50% down payment, with the remaining 50% due upon project completion.
Once the down payment is received, your order is added to our queue. The deposits are non-refundable because work on the project begins as soon as the deposit is received.
We offer flexibility in the percentage and number of payments; specific arrangements must be resolved individually.
Upon completion of the commission, a full gallery will be provided for review. Only after approval will the final payment be requested, and the models dispatched via the selected shipping option.

6. Shipping
The Studio is responsible for shipping miniatures to the customer.
Shipping costs include packaging materials, shipping, and insurance. Customs fees are not included and vary depending on the destination country. The shipping cost is determined individually and sent along with the project quote.
In the rare event of courier loss, the Studio will repaint the entire order at no additional cost. Unless the client waives the insurance – in such cases, we are not responsible for the lost shipment.
If outer packaging is damaged, open the package in the courier's presence to verify the contents’ condition. A courier claim form ensures we can repair or replace damaged items.
International shipments may incur import taxes, customs duties, and other fees upon arrival. Buyers are responsible for these additional costs.
The customs code for miniatures in the US is "9503.00.00 Toys, including riding toys other than bicycles, puzzles, reduced scale models." These items are often exempt from duty fees but may still incur taxes.
7. Returns
The down payment is non-refundable.
Each project is made-to-order, beginning immediately with model procurement and project planning.
If the Studio damages a miniature during the painting process, it will repair or replace the miniature at no additional cost.
The no-return policy also applies to entrepreneurs making purchases related to their business activities but not of a professional nature for the buyer.
8. Warranties
The Studio guarantees that its services will be performed professionally and in a timely manner.
Queue times provided indicate the wait period before work begins. For example, a queue time of 15+ weeks means the project starts after 15 weeks.
9. Liability
The Studio is not liable for damages, including but not limited to direct, indirect, incidental, or consequential damages arising from the use of its services or models.
Complaints can be made if the model is damaged during transport, provided that a damage report is completed in the presence of the courier. In that case, we cover the costs of collecting the models from the client and repairing them, provided the client has used the previously mentioned shipping insurance. A used product cannot be subject to a complaint.
This policy also applies to entrepreneurs making purchases related to their business activities but not of a professional nature for the buyer.
10. Changes to Terms
The Studio reserves the right to modify these Terms at any time. The most current version will be posted on the Studio’s website.
11. Entire Agreement
These Terms constitute the entire agreement between the customer and the Studio regarding the use of its services. They supersede any prior agreements, representations, or understandings.
12. Governing Law
These Terms are governed by the laws of the Polish Office of Competition and Consumer Protection.
13. Severability
If any provision of these Terms is deemed invalid or unenforceable, the remaining provisions will remain in full force and effect.
14. Waiver
A waiver of any provision of these Terms will only be effective if in writing and signed by both parties.
15. Headings
Section headings in these Terms are for convenience only and do not affect their interpretation.
16. Counterparts
These Terms may be executed in multiple counterparts, each considered an original but together forming one agreement.
17. Binding Effect
These Terms bind and benefit the parties, their successors, and permitted assigns.
18. Authority
Each party represents and warrants that they have the full authority to enter into and perform their obligations under these Terms.
19. Governing Language
These Terms will be interpreted and enforced in the English language.
20. Withdrawal from the contract.
You are not entitled to withdraw from the contract. This policy also applies to entrepreneurs making purchases related to their business activities but not of a professional nature for the buyer.
The goods provided are non-prefabricated, produced according to yours specifications, and intended for your individual needs.
You are obligated to pay the price if the Studio has fully performed the service with your explicit and prior consent. You are informed before the service begins that once the Studio has fulfilled the service, you will lose the right to withdraw from the contract.
Acceptance of the quotation constitutes acknowledgment of the loss of the right to withdraw from the contract.
If your commission is completed and we do not hear from you, we will make multiple attempts to contact you, using different email addresses and possibly WhatsApp if we have your phone number, to ensure our messages reach you.
21. Payment Delay
If you are unable to pay for your commission, just let us know — we’re happy to postpone the payment or arrange an installment plan tailored to your situation.
However, if your commission is completed and we do not hear from you for one month, we will prepare a final notice and notify you via multiple channels (email, and possibly WhatsApp if we have your number).
If two full months pass without any communication, your models will be prepared for auction.
We can wait up to six months for payment, but only with regular contact. A lack of communication is what triggers the auction process — not the lack of payment alone.
22. Project Completion Time
We usually inform about how long is our commission queue in our e-mails.
The queue time we provide is the lenght of how long will your order wait until we start working on it.
So if the queue is 18+ weeks long, it means that after the 18+ weeks have passed we will start assembly/converting/painting etc.
The completion time depends on the quality of the painting, the complexity of the project, and the number of models we are working on.
23. Leftover model parts
Any extra bits, spare bases, or unused model elements from your project will be disposed unless you specifically request them to be returned. If you'd like us to send them back, please let us know when placing your order.
